The re-use of public information is a use for purposes other than those of the public service mission for which the documents were produced or received. This re-use is governed by the code of relations between the public and the administration (CRPA, articles L.300-1 and following).
The re-use of public information may concern any person, whether natural or legal, private or public.
Only public information contained in documents that can be freely communicated to all and on which third parties do not hold intellectual property rights can be re-used within the meaning of the CRPA. In the event of the presence of intellectual property rights held by third parties, the re-user must obtain the necessary authorisations from the holders of these rights or their successors. Without these authorisations, the person who has obtained a copy of a document on which a third party holds intellectual property rights can only make the uses provided for in article L.122-5 of the Intellectual Property Code.
The re-use of information containing personal data is subject to compliance with the legal framework for the protection of personal data. The administration cannot be held responsible for the reuser's failure to comply with the legal framework.
Articles L.324-1 to L.324-5 of the code of relations between the public and the administration establish the principle of free re-use of public sector information. Within this framework and subject to the indications given above, the archive documents kept by the Historical Service of Defence that are freely communicable and free of rights may be used freely and without charge. The re-user is required to indicate in the form: © Service historique de la Défense, document reference, for any use he makes of the documents.
Failure to comply with the rules of re-use exposes the re-user to the penalties provided for in article L.326-1 of the code of relations between the public and the administration and, in the case of failure to comply with the rules relating to the re-use of personal data, in articles 45 and following of law 78-17 of 6 January 1978 relating to information technology, files and freedoms.
Commercial publishers wishing to publish a large number of documents held by the SHD in a book are invited to contact the communication and development office for their procedures: shd-vincennes-valorisation.chef.fct@intradef.gouv.fr
